Terms & Refund Policy

These terms govern your use of Fox Creek Foundry’s website and your purchase and use of Heron. Fox Creek Foundry LLC (“we,” “us,” or “our”) is the publisher of Heron. By using the website or purchasing Heron, you agree to these terms.

Heron license

Subject to these terms and payment of the applicable price, we grant one individual a personal, non-exclusive, non-transferable license to install and use Heron on up to three (3) computers that person owns or controls, for personal or internal business use. The software is licensed, not sold. You may not copy, distribute, rent, lease, sublicense, reverse engineer, or attempt to extract the source code except where applicable law does not allow that restriction.

Purchase and delivery

Heron is a digital software product. Prices are shown in U.S. dollars unless stated otherwise and may change before purchase. Checkout, applicable taxes, payment processing, receipts, and payment-related support are handled by Lemon Squeezy, our merchant of record. After payment is confirmed, download and license-delivery instructions are provided electronically.

Free trial

A free 14-day trial of Heron is available. The trial is the complete application, not a reduced version of it, and it does not require an account. When the trial period ends, a license is required to keep using Heron. Documents you created during the trial remain yours and stay on your computer as ordinary files.

14-day refund policy

Because Heron is delivered as downloadable software, we ask that you tell us within 14 days of purchase if it is not right for you. Contact us through our contact form within that window, for any reason, and we will refund you. After 14 days, if you run into a reproducible issue that prevents Heron’s core functionality and we can’t provide a fix or reasonable workaround, contact us and we’ll review the issue and make it right, which may include a refund.

This policy does not limit any rights you may have under applicable law.

Updates and support

Your purchase includes the current version of Heron and all updates released in the 1.x series. Future major paid upgrades, if any, will be optional and clearly identified before purchase. We provide support through our contact form; we aim to respond within two business days. We do not promise a particular feature, update schedule, or uninterrupted availability.

Acceptable use

You may not use our website or product to violate law, infringe another person’s rights, interfere with our services, distribute malicious code, or attempt to gain unauthorized access to our systems.

Disclaimers and liability

Heron and this website are provided “as is” and “as available” to the extent permitted by law. We disclaim warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, Fox Creek Foundry’s total liability for a claim relating to Heron or this website will not exceed the amount you paid us for Heron in the 12 months before the claim. Nothing in these terms limits liability that cannot legally be limited.

Changes to these terms

We may update these terms from time to time. The updated version will be posted here with a revised effective date. Continued use after an update means you accept the updated terms, except where applicable law requires additional notice or consent.
